The European Parliament's Petitions Committee is to be asked to adjudicate on the lack of legal representation for the McBrearty family at the Morris Tribunal.

Fine Gael MEP Jim Higgins said he would ask the committee to rule on whether the denial of legal representation is in conflict with the EU's Charter on Fundamental Rights.

Senator Higgins, who was one of the first to raise the McBrearty case in the Dáil, said he understood the frustration which led to Mr McBrearty's walkout from the tribunal today.

Mr Higgins said it was 'absolutely bizarre' that the family at the centre of the tribunal, and which has been completely cleared of any wrongdoing, is left 'totally exposed' before the legal teams of the Minister for Justice, the Garda Commissioner and the Garda Representative Bodies.
