Curtin given leave to seek judicial review

The Circuit Court Judge, Brian Curtin, has been granted leave to seek a judicial review of attempts by the Oireachtas to remove him from office.

The Circuit Court Judge, Brian Curtin, has been granted leave to seek a judicial review of attempts by the Oireachtas to remove him from office.

Lawyers for the judge, who was acquitted on child pornography charges earlier this year, said that efforts to remove him from office were an attempt to secure a parallel conviction.

The Oireachtas committee set up to investigate the judge as part of the process of removing him from office had ordered him to hand over his computer.

That order will now be frozen pending the judicial review proceedings next year.

Judge Curtin's lawyers said the procedures employed by the Oireachtas in seeking to remove Judge Curtin from office were unconstitutional and unlawful.

Senior Counsel John Rogers said that forcing Judge Curtin to answer questions before an Oireachtas committee amounted to forcing someone to incriminate himself.

He said the committee was trying to investigate the very matters for which Judge Curtin was acquitted.
