High Court upholds deportation order

A Nigerian woman is facing imminent deportation after the High Court rejected her argument that she faces a death sentence for adultery if she returns to Nigeria.

A Nigerian woman is facing imminent deportation after the High Court rejected her argument that she faces a death sentence for adultery if she returns to Nigeria.

The court turned down an application by Nomota Bamidele, 39, to seek leave to appeal her deportation order. 

Counsel for Ms Bamidele argued that in parts of northern Nigeria people who contravene Muslim Sharia law suffer amputations, caning and stoning.

The court was told Ms Bamidele was in a particularly precarious situation as she was a convert from Islam who had three children with a Christian man outside marriage. 

Counsel for the Attorney General argued she would be deported to Lagos where Sharia law was not applied.

Mr Justice Vivian Lavin accepted the decision of the Immigration Bureau that Ms Bamidele should be deported.

He also refused her leave to appeal for a judicial review and leave to appeal to the Supreme Court.
