Forensic psychologist before Barr probe

Updated: 16:57, Wednesday, 24 March 2004

A British forensic psychologist has told the Barr Tribunal he believes that John Carthy wanted police to shoot him at the end of the Abbeylara siege.

Dr Ian McKenzie, who was giving evidence for a second day today, told the inquiry he felt the motivation behind Mr Carthy emerging from his home after 25 hours, was his desire to be shot by the armed gardaí outside.

This opinion has been raised at the tribunal before, under the controversial heading of 'suicide by cop'. Dr McKenzie told the tribunal he does not like to use that term. Instead, the psychologist refers to such incidents as 'police involved victim provoked shooting'.

The psychologist dismissed suggestions from Justice Robert Barr that Mr Carthy may have come out of his house in order to go to his sister and psychiatrist, whom he knew were in the area.

The doctor said he believed the presence of Marie Carthy and Dr David Shanley were irrelevant to Mr Carthy at that stage, pointing out it would be very strange to approach your sister and psychiatrist with a loaded gun.

RTÉ application upheld

Earlier today in a separate development, Justice Barr upheld an application from RTÉ, ruling that the media module at the tribunal will not consider whether Mr Carthy heard a controversial 5-7 Live broadcast shortly before he emerged from his home.

The tribunal had originally intended to consider the likelihood of Mr Carthy hearing the broadcast, and the impact that that may have had on him. Presenter Myles Dungan used Mr Carthy's name for the first time, and reporter Niall O'Flynn conducted interviews with locals, who aired details of Mr Carthy's personal life.

Last week, RTÉ made an application to the inquiry, on the basis that any analysis of the impact of the programme on Mr Carthy would be entirely speculative, due to the fact that it will never be known if the 27-year-old manic depressive actually heard the broadcast.

Judge Barr upheld this application today, saying he appreciated that it would be very difficult to be satisfied that Mr Carthy heard the broadcast, or that it influenced him to take the subsequent action of leaving his house.

Content of programme to be considered

However, the judge ruled that the media module would continue, saying there are still a number of issues in relation to the 5-7 Live broadcast that need to be examined. A date for commencement of the media module has not yet been set.
