Judge refuses Shannon case jurisdiction

A judge has refused jurisdiction to deal with a case in which a woman is charged with causing criminal damage to a US naval plane at Shannon Airport in January.

A judge has refused jurisdiction to deal with a case in which a woman is charged with causing criminal damage to a US naval plane at Shannon Airport in January.

Mary Kelly, 50, and with an address at the peace camp at Shannon and at Baltimore in Cork, faced a fresh charge when she appeared at Ennis District Court today.

She is charged with trespassing on airport lands on 29 January, on top of the charge of causing damage to the US plane on the same date.

The cost of the damage has been estimated at over €100,000. Ms Kelly is pleading not guilty to the charges.

The court was told today that the DPP had consented for the case to be dealt with in the District Court.

However, Judge Joseph Mangan declined jurisdiction to deal with the matter when he heard the cost of the damage involved.

The case has been put back until 2 May for the preparation of the book of evidence so that the case can be heard in the Circuit court.

Ms Kelly's bail conditions stand, wherein she is not allowed to enter County Clare, and has to sign on three times a week at Skibbereen Garda station.

An application to reduce the signing on obligation to once a week because of hardship was refused.
