In a submission today, Mr Cosgrave's lawyers said the inquiry had failed in its obligation to test the credibility of the former Government Press Secretary and Fianna Fáil lobbyist as a witness and therefore should not continue its work.

The Tribunal was also accused of operating a witness protection programme for Mr Dunlop.

Mr Cosgrave's lawyers have been making a detailed submission to the Tribunal expressing what was described as 'deep concern' about the way in which evidence was taken from Mr Dunlop.

Councillor Cosgrave has asked for details of private meetings which Mr Dunlop had with the Tribunal and whether or not it has referred any matters to the DPP.

Councillor Cosgrave has denied receiving a number of cash bribes from Mr Dunlop in the 1990s.
