Liam Lawlor,Abandoned his challenge to the High Court's jurisdiction ruling
The High Court will decide tomorrow on the request from lawyers for the Flood Tribunal to consider jailing Liam Lawlor. It is the first time the Tribunal explicitly asked the Court to consider such a move.
The lawyers requested the Court to consider imposing some, if not all, of the remainder of the three-month suspended sentence imposed on the Dublin West TD a year ago.
In closing remarks, Frank Clarke, SC for the Tribunal, said that there was a clear and very substantial breach on Mr Lawlor's part of his obligations towards the inquiry.
He said that, at this late stage, it warranted the court taking a very serious view. Mr Lawlor's lawyers said that their client had made a very careful effort to comply with the Tribunal
Earlier, Mr Lawlor decided not to challenge in the Supreme Court yesterday's High Court ruling against him. The High Court is currently reviewing his level of compliance with the Flood Tribunal.
Mr Lawlor's lawyers unsuccessfully challenged the High Court's jurisdiction in this matter yesterday. When the High Court hearing adjourned, Mr Lawlor's team immediately went downstairs to the Supreme Court, but that court was not sitting.
This morning, Mr Justice Thomas Smyth ruled against an application by the Tribunal to cross-examine Mr Lawlor. He said that it was not the appropriate forum.
