Dunphy case adjourned to April

Eamon Dunphy has had his prosecution for an alleged drink driving offence adjourned until next April because of High Court proceedings involving the new testing system for breath alcohol levels.

Dublin District Court heard that the journalist and broadcaster was arrested on Sunday 28 October at 5.35am in Dublin's Camden Street. He was then taken to Pearse Street Garda Station.

This is an intoxilizer case and such cases are currently being adjourned pending the outcome of High Court proceedings challenging the validity of this system.

The computerised intoxilizer measures breath alcohol levels and can print off an instant reading. It has eliminated the need for doctors to be called to stations to take blood or urine samples for analysis.

However, if High Court actions prove successful thousands of prosecutions using this system could be struck out.
