High Court to be asked to rule on controversial affidavit

The High Court is to be asked to prevent a controversial affidavit being introduced in evidence at the Flood tribunal.

The High Court is to be asked to prevent a controversial affidavit being introduced in evidence at the Flood tribunal. The Murphy Group legal team is expected to make an application to the court tomorrow, after Mr Justice Flood ruled that the affidavit could be discussed in public at the tribunal. The affidavit in question was sworn ten years ago by the now deceased former JMSE chief executive Liam Conroy during proceedings in the Isle of Man.

It is believed to contain serious allegations about Joseph Murphy senior. The Murphy Group legal team has been trying to keep its contents private, claiming that it is peppered with lies. However, this morning, Mr. Justice Flood ruled that the contents could be discussed at public sittings of the tribunal. He pointed out that Mr Murphy senior would be able come to the tribunal to give his version in relation to any allegations in the document.

Counsel for the Murphy group immediately indicated that he would be taking the matter to the High Court. The process of seeking a judicial review will be started tomorrow. In the interim, counsel for Mr. Gogarty was prevented from asking him questions about the affidavit. The outcome of the court proceedings will dictate whether or not tomorrow will be James Gogarty's last day in the witness box.
