The murder trial of Joe Delaney has resumed this morning in the Central Criminal Court. Mr. Justice Quirke decided the trial should proceed with eleven jurors and rejected an application made on behalf of the Director of Public Prosecutions that the jury should be discharged.
The move followed the discharge of one juror last week who realised he had had indirect contact with a prosecution witness, and revelations from the jury that they were worried about their own safety once the trial had ended. The jury foreman had indicated to the court that some jury members had felt that they were subjected to an atmosphere of intimidation in the courtroom last Wednesday.
The Jury foreman said his fellow jurors are now very happy with the security arrangements that have been put in place. They now have Garda security coming to and from the Four Courts and all, except those associated with the trial and members of the Press, have been excluded from the courtroom.
