Terms and Conditions
Request & Supply of Archive Material- Broadcast/Publishing/Media Production/Commercial Production

• These terms and conditions apply to the provision of archive material to the following groups, including, but not limited to: broadcasters, media production companies, publishers, advertising & marketing agencies, all corporate enterprises.
• A minimum research charge will apply.
• Customers must have paid by credit card or cheque or have completed a credit account with RTÉ Libraries and Archives.
• Where search criteria is vague or unclear, RTÉ Libraries and Archives may request further information or advise that it is unable to complete the requested order.
• Completion of the request form does not guarantee delivery of materials.
• Supply of material from the RTÉ Libraries and Archives is subject to availability, preservation status, copyright law, and to the discretion of RTÉ Libraries and Archives at all times.
• There is no obligation by RTÉ Libraries and Archives to supply.
• While every effort will be made to fulfil your request in the shortest period of time, RTÉ Libraries and Archives accept no liability for any delay or disruption which may arise in respect of your request.

Licensing Archive Material

Use of material supplied by RTÉ Libraries and Archives for broadcast/media production incurs a licence fee. The cost of this licence fee depends on the rights/clearance requested, and in relation to RTÉ Television and Radio material, on the duration of the material used.

Payment generally must be made in advance of supply of broadcast/publication quality CDs, DVDs, audiocassettes or photographs containing archive material, except with regular business customers who may be set up with a credit account.

Licensing of Archive Material-
Broadcast/Publishing/Media Production/Commercial Production

• Material is provided on a strictly non-exclusive basis for use in one specified production or publication only.
• Material must not be used in a manner that is detrimental to any person or body.
• The user is responsible for clearing all music, appearance and performing rights and will indemnify RTÉ against any claims resulting from a failure to clear such rights. Written confirmation of clearance will be required from copyright holders in advance of supply of broadcast/publication quality material.
• All library fees, duplicating costs, shipping costs and minimum royalty fees are payable in advance of supply of any copies.
• The minimum non-refundable royalty fees for RTÉ Television or Radio archive material paid will be deducted from the final fee payable if that should be greater.
• Royalty fees for usage of RTÉ Television or Radio archive material are charged according to length used on receipt of a usage declaration. Charges for use of photographic material are based on RTÉ Stills Library rate card. If no usage declaration is received within 30 days from date of supply, royalty fees are payable on total length or number of images supplied for the specified use.
• Research by RTÉ staff incurs a €60.00 charge per hour or part thereof.  The research fee applies even if the archive material is not used.
• Any additional usage of RTÉ copyright material (in publicity campaigns, review articles etc.) needs to be cleared with RTÉ Libraries and Archives first.
• RTÉ Libraries and Archives require a credit in publication or broadcast where RTÉ archive material is used.
